    Post Mi 50/50 Custody Mod, Fathers Second Dui, Mother Seeks Full Custody

    My question involves a child custody case from the State of: MI (CA/FL).
    My ex and I divorced in MI, we have 50/50 legal & physical custody. My ex has gotten a second DUI (there are many other factors that make me worry for my son's benifit). I would like to modify my custody agreement but am not a resident of MI and will soon be retiring from the military and relocating. My question is, can I file for the modification with MI, do I file with CA and would I have to stay in CA until judgement or do I have to wait and file in FL? The sooner I file the better, my child is due to go back to my ex about mid year.

    What are you actually trying to accomplish?

    Are the orders out of MI?

    What exactly is the time-share in terms of physical custody?

    Finally, on what basis do you wish to change custody? (A DUI if the child wasn't present is not generally going to be enough)
