    Default Did Not Complete PC 1000 Drug Diversion

    My question involves criminal law for the state of: California
    I was placed in a drug diversion program (PC1000). I felt the program I was told to go to (NCADD) was not the correct program for my situation. I tried to communicate this to my probation officer, looking for advice on how to proceed. I would call and leave messages several times a week, never receiving a response.

    Approx. 3 Months into the program I was able to speak to a counselor, one-on-one, for the first time. I told them that I felt I was in the wrong program and informed them of my medical history. The counselor stopped the session and informed me that she could not discuss this subject any further, she was not a medical professional, and was not qualified to advise me on my situation any further. She suggested I take a leave of absence from the program and see my doctor for a proper diagnosis (ADHD-PI I think).

    I went to Kaiser as suggested, was told there was a very long waiting list, was told there was no 'waiting list', several times was told someone would contact me in a couple of weeks. This entire time, leaving messages, with probation officer (status updates, questions, concerns, appointments) several times a week (30 to 40 messages total).
    NEVER hearing back from anyone anywhere, frustrated and not knowing what to do, I did nothing.

    I am now told by the DMV that I can't renew my DL due to a failure to appear. I would have happily appeared if someone would have informed me.
    Probation never contacted me, the courts never contacted me, nothing, no phone call, no mail, nothing.

    I am confused, scared, and full of dread. I do not understand how this system works or what I am to do next.

    It is my understanding that when you are placed on a PC1000 program, you are placed on an "informal probation" which means that you are not asigned to a particular probation officer; so I'm not sure who you were calling (30 to 40 times) to tell him/her that you were in the "wrong program". Did it ever occur to you that maybe you should have gone "TO" the probation department, request to see someone in person to discuss the matter with him/her?

    Also, I'm not sure how your undiagnosed ADHD-PI is in anyway related to your being in the wrong PC1000 program and even if you were, I'm not sure how your not attending your PC1000 classes would result in a hold being placed on your license with the DMV.

    As for your "failure to appear" is it possible that you received a traffic citation that you somehow forgot about? Or, is it possible that you had a "status update" date for your PC1000 case set up with the court that you failed to appear to?

    As you can tell, it is difficult for anyone here to answer any of those question and as such, it would be in your best interest to contact the court and/or the probation department (or preferably both) immediately to get the matter resolved with them.
