    Exclamation Second MIP

    My question involves criminal law for the state of: California

    I was charged with a MIP once and had it dropped down to an infraction after completing a special program and paying my fines. This time I was in my dorm with a friend who was 21. I didn't know he had put vodka in my fridge, I thought we had finished it earlier. Officers came to my dorm and found the vodka, my friend who is 21 confessed it was his. I got an MIP, advice please!

    "Somebody else bought it" isn't a defense to MIP. "I thought I drank it all" isn't a defense to MIP.

    What I mean is, my friend who is 21 admitted to the alcohol being his, in which case it was not mine. I did not admit to drinking and do not believe the alcohol was in my possession, in fact my friend said it was in his possession. My question is will this stand a chance in court, also since I am turning 21 in May and my court date is in April will that help my case in some way?
