    Default Paying Customer, Left Car Overnight, Car Towed in the Morning

    My question involves towing laws for the State of: Indiana.

    Recently I parked in a parking lot which has signs posted saying "Monitored Lot. Customer Parking ONLY. Violators towed at owner's expense". I parked my car in a spot, then went to a bar located on the property. I ended up leaving my car in the parking lot overnight, thinking that since I had been a paying customer at one of the bars located on the property then my car would be safe. I took a bus back to a friend's place that night, with the intention of retrieving my car the next morning. When I went back the next day to retrieve my car, it had been towed.

    I am wondering if they had any actual right to tow my car because I was a paying customer and I have a receipt showing purchases made from a business located on the property. There was nothing posted about leaving cars overnight, and there was nothing posted regarding a time limit to how long you could park on the property. Due to these thing, I thought it safe to assume that if I was buying something from one of the many businesses located on the property then I am considered a customer and should not have to worry about my car being towed.

    Right now I am considering taking this to small claims court. I have a receipt showing that I made purchases from a business located on the property that night, and photos of the signs posted in the parking lot. All the signs make no mention of any time limit or overnight parking. They just say "Monitored Lot. Customer Parking ONLY. Violators towed at owner's expense". Did I stop qualifying as a customer as soon as all the stores in the mall closed? Any help is appreciated. Thanks.

    Customer parking means while you are on the premises. Just because you bought a drink doesn't give you perpetual parking privs.
    If you were too drunk to drive, you should have coordinated with the bar to leave the car there while you took other transportation.
    It's doubtful you have any claim.
