    Default May the Disabled Adult Child of a Deceased Person Draw on Their Social Security

    Facts:

    father recently deceased, 18 months ago
    paid into SS for 45+ years
    died unmarried

    I am the adult son, 55 years of age, VA rated 80% disabled with 100% permanent unemployability

    Am I eligible and legally able to draw upon his SS ?

    If so, how do I proceed?

    Unless you became disabled before age 22, you cannot. I would assume that you became disabled after age 22 because of the VA rating but perhaps you haven't worked since your military service under age 22.
