    Default How to Fight a Motorcycle Speeding Ticket and Win

    My question involves a speeding ticket from the State of: Los Angeles, Ca

    This past weekend I was pulled over by CHP on a Motorcycle. He was behind me and quickly got next to me and told me to pull over. (We where both on a motorcycle) I exited the Freeway and proceeded to stop. He indicated I needed to get off the motorcycle and take off my helmet (Which I did) He of course asked for License, Registration and Proof of Insurance.

    He said that the reason I was pulled over was due to the fact that I was going 95mph when in fact the posted limit was 65mph. I was polite towards him but he was a grouch =) didnt let me go with a warning which in all fairness its his job and I shouldnt have been speeding. I also currently posses a CLASS A license. He wrote the ticket and let me go. However, since he wrote 95mph on a 65mph I'm sure to get a point and a half on my license not to mention the insurance will be sky high.

    Is there any way I can fight this ticket and win? I am horrified of the fact that I can get a point and a half if not more on my Class A license and well that my sorce of income.

    Any help, Advise and or suggestion will be truely appreciated. Thank you in advance.

    What CVC section were you cited for? What method of clocking did he indicate on the citation? Theses are a but a few bits of info that will help others help you.

    Probably 22349(a) and it sounds like a pace...

    Yes you can fight it but realistically, your only chance of winning would be if he doesn't file a declaration (if you choose to fight it by Trial By Declaration) or if he doesn't appear at an in court trial.

    Of course with you holding a class A license, you are NOT eligible for a dismissal via traffic school, so you haven't got much to lose by fighting it with a TBD and if you lose, go to a Trial De Novo in hopes that he won't show up.

    Unfortunately, holding a commercial license removes traffic school from the table by statute. Even if someone is cited for 68mph in a 65mph zone, it's still a point and a half. The good news is that some judges realize the disproportionately severe impact even a single traffic conviction has on a CDL holder and I've seen charges get dropped to non-movers in such cases.

    As TG pointed out, winning a VC22349 case by yourself boils down to getting lucky. Since your livelyhood is on the line, I strongly suggest consulting with an attorney who specializes in traffic cases and practices out of LA county. Still, getting 95 in a 65 reduced to a non-mover would require a pretty liberal judge AND an attorney who smokes weed with same judge every other day.

    =) Hmm well thanks for the info. I know it sucks, my fault for speeding - I'll still plea NOT GUILTY I dont loose by trying. Never in my life had i gotton a traffic ticket & to get one for speeding serves me right. Still hope I win (: Thanks AGAIN!!!!!
