    Default False Abuse Charges

    My question involves child abuse or neglect in the State of: New Hamshire
    I was accused Of child abuse by my stepsons mother. 4 years later he told his therypist that she made him lie and there was no abuse.We told the courts this and to have them contact his therypist to verify this (after his therypist told us to ask the courts for help) and the courts would not.what can I do know?She also is still making her son lie.

    What is over is over, but if at all possible get a written letter/document from his therapist that you can use in the future.

    Were you convicted of a crime? Were you ever charged?

    If you suffered some harm or adverse effect as a result of the accusation, you can always seek to sue her for any damages. But, it may be hard to prove that she did it. A son's recanting to a therapist is not proof that the accusation was knowing and intentionally false, only that the boy lied ... either when he first supported the accusation, or when he spoke to the therapist. If you feel you have a cause of action, then consult an attorney who can evaluate the case for you and recommend a course of action - if any.

    Well its a long story,but we fought her in mass and after two years the mass courts said this case should have been heard in nh, so they through it out and we had to start over in nh (in mass the G.A.L said we should have custody)well the day it was thrown out of mass she called dcyf.In nh court they said my husband could not see his son at all,that was nov 2005,we did not get back in court till april 2006 that is when they said to much time has gone by and a reunifacation therypist will have to be involved.my husband has been in his life since day one.Dcyf said they did not knmow what happened but they said he is in no danger at our house.

    I dont need a letter the therypist said he would tell the courts himself but the courts said they will not talk to him.

    True, but the therypist will talk

    My stepson was not the one that told her she told him to say it from the begining.He was afraid not to lie because of what she would do.

    I was never conviceted but I am on record as an abuser,I can not get a job in a daycare center if I wanted.I just want my name out of there system and her to be punished for making faulse charges.

    It is very difficult to make a case for making a false report. About all you can do is bring this up to the police and ask that they consider an investigation for making a false police report.

    As for removing your name from whatever abuse database that might exist in NH, that might be a tougher nut. You would have to investigate the procedures necessary to get that accomplished if it is even possible. But, again, you are left in a situation where if mom continues to claim she believed the accusations and the son is recanting, then all it proves is the son lied ... then or now - at some point he lied, and his credibility is suspect. If mom has not confessed, then she can assert she believed the claims.

    Absent a confession by mom or some other sort of verification the claim of a false report MAY not be an allegation that can be proven.

    You might consider consulting an attorney that deals with family law matters for some guidance.
