My question involves criminal law for the state of: New York
My boyfriend was accused by a former employer of writing checks in excess of his what he was to be paid. At this time we were not told of how much money is in question. All that we know is that his charge is Petit Larceny. He does have prior DUI charges for which he served 8 months jail time about 5 years ago. His record has been clean since then. At his initial court date his public defender was encouraging him to take a plea, but he refused as he did not commit the crime for which he is accused. He said that both sides seemed very unprepared, and that the Plaintiff had to "find" the checks in question. This has been very upsetting to both of us as he is trying to get on with his life after being in prison which is hard enough as it is. Does anyone have any advice as to what we should do? Can you tell me what sort of punishment he may be looking at? Thanks!
