    Default Changing Venue for a Speeding Ticket, VC 22349(A)

    My question involves a speeding ticket from the State of: CA 22349a

    Two tickets in 3 months

    So I was going from San Francisco to Reno. Time was around 9:45pm, 2-7-2010 Superbowl Sunday. I was caught doing 86 mph, officer cited me for doing 70 mph @ a 65mph zone. I was most likely clock with a lidar, or radar. Officer only gave an unit number but not the type of gear. Also when he asked me how fast I was going, I said I think 75.

    When I was handed the ticket I asked can I have a change of venue as Truckee is 160 miles from where I live and work. I was told there are no change of venue for traffic infractions.

    I wanted to know:

    Can I request for a change of seat on the arriangment date back to San Francisco, and would I be granted one?

    I wish to have this lower to a non point moving violation, how do I go about asking for that?
    -Do I ask the DA office?
    -Prosecutor

    The only change of venue you are going to be able to get is to Nevada City. It's the county seat of the county you're charged in.

    The officer said I was doing 86, but cited me for 70. If I go to court and lose could I be charge with going 86 at a 65? Also would I be disputing the speed a 5 mph margin of error, or a 21 mph margin of error?

    Also if I do no contest or guilty with an explanation during arraignment does the judge have the power to reduce it to a non-moving violation? I mean 5mph over the speed limit coming off a incline, and going to a decline isn't too bad.

    Also during the arraignment does the judge or prosecutor have a copy of the officer notes that shows he clocked me at 86 mph?

    And if I decide to start with a TBWD can I still go to my arraignment?

    I know this may be a little too late but have you tried any of the numerous "ticket busters" here in Nevada? I got a ticket in AZ (going 35 over on our way to Scottsdale) and one of the local agencies was able to get the ticket reduced to a parking violation and no points on my license.
    Dude... the ticket was in CA.

    Keep on telling cops you are speeding & you'll always get tickets you cannot beat.
