    Default Can CPS Remove My Children

    My question involves child abuse or neglect in the State of: ARIZONA,
    IN 2008 MY HUSBAND AND I TOOK CUSTODY OF MY 2 STEP SONS, DURING THIS CUSTODY BATTLE THE KIDS LIVED WITH US, I HAVE 3 OF MY OWN KIDS AND TWINS WITH MY HUSBAND. IN THIS TIME OF CUSTODY, MY OLDEST SON WHOM WAS 12 AT THE TIME SEXUALLY ABUSED MY 10 YR OLD DAUGHTER REALLY BAD WHEN WE WERE SLEEPING. AFTER 5 MONTHS SHE TOLD ME WHAT WAS GOING ON WE TOOK THE RIGHT MESSURES INFORMING THE POLICE AND CPS. HE WAS REMOVED FROM THE HOME AND CHARGED. HE IS STILL DEALING WITH HIS OWN ISSUES, NOW MY YOUNGEST DAUGHTER WHO IS 8 HAS DISCLOSED TO ME THAT MY OTHER STEP SON THAT STILL LIVES WITH US HAS TOUCHED HER AND MY OLDEST DAUGHTER HAS ALSO SAID HE HAS TOUCH HER AS WELL, WE REPORTED IT AN INTERVIEW OF ALL MY KIDS WAS DONE AND THE CONCLUSION WAS THAT HE DID DO THE THINGS THE GIRLS SAID AND HE TO HAS BEEN REMOVED FROM OUR HOME AND IS NOW IN JAIL AWAITING TRIAL. HE IS 13. MY QUESTION IS CPS IS INVOLVED AGAIN BUT THIS TIME THEY ARE KEEPING MY CASE OPEN THE CLAIM IS THAT WE CAN'T PROTECT OUR CHILDREN. I AM REALLY WORRIED THAT THEY WILL TAKE MY KIDS FROM ME. I AM A GOOD MOM, I SPEND EVERY MINUTE WITH MY CHILDREN THAT I CAN WHEN I AM NOT INSCHOOL OR SLEEPING. CAN CPS TAKE MY KIDS?

    Please don't type in Caps - it is considered "shouting".

    That aside...yes, CPS can remove your children. You are apparently not providing a safe home for them.

    (And really - did your husband's custody order actually include YOU?)

    In order to have ANY crime, you need 3 elements.

    1) a person motivated to commit a crime
    2) a vulnerable victim or target
    3) a place lacking sufficient oversight or guardianship

    One household. Multiple sexual abuse incidents. Two different perpetrators, who developed the motivation to commit similar offenses, against similar victims. Absolutely, CPS has a DUTY to the children to remove them from whatever dynamic is in play that is fostering this type of behavior under your roof.

    Yes, and they should. And you and your husband should get your tubes tied/vasectomy pronto.

    Yes they can take your "at risk" minor children if they can prove there is an immediate danger to their safety or they are not being properly supervised. They will extensively interview your entire family and ascertain if the other children are at risk.

    Minor children being sexually active and predatory indicates they were sexually abused as well or there are some serious underlying psychological/mental issues I strongly suggest your family get into counseling. This will work in your favor and it will help your family to deal with the trama in a positive manner. If you dont have insurance to see a counselor the CPS officer in charge of your case can direct you to facilities that are sponsered by the government. My heart goes out to your family and I will be praying for you.

    Thank you for your words of hope and encouragement. We have been in counceling since my first step son's case, it has slowly been comeing out that both of my step sons have seen sexual activity while under the care of their bio mom. It also has come out that they were abused themselves around the same times too. thank you again for your encouragement and your prayers. There is adequate supervision, i am with all of my kids all the time unless they are in school, we are sleeping (normal sleep hours 10pm-6am) or they are at a friends house. I am very involved in their lives. thanks again
