    Default Accused of Petty Theft Misdemeanor but Case Won't Go to Court

    My question involves criminal law for the state of: CALIFORNIA

    Hello I was accused of the theft of an item worth $350 in CA last year, and I was pulled out of my class in school (under 18) to go to the office and got a citation. Eversince, the person that accused me has not contacted the police and demanded any restitution. It has been 8 months from the start, and I have not taken anything. The probation officers are trying to not let this go to court and trying to get me to join their programs or something and have this on my record for 2 years. A few days ago. they contacted my mother, and said that the case was too small to go to court or something and that the case has been transferred to another PO.

    What is going to happen? I just want this to be over already it has been stressing me for long enough. I am trying to not get anything on my record.

    If you are being offered a disposition that allows you to avoid going to court if you keep your nose clean for two years, that's usually a good thing.

    We have no way of investigating your situation beyond what you tell us, and you really haven't told us what is going on.

    Why should I admit to something I didn't do and have it on my record for 2 years?

    As you apparently missed it the first time, we have no way of investigating your situation beyond what you tell us, and you really haven't told us what is going on.

    Talk to your lawyer or, if you don't have one, consult a local lawyer with the details of your case.

    If you are innocent, and do not want to comply with the requests of the Probation Department, then decline their offer and compel them to take you to court if they feel they can make the case.

    Only YOU know whether or not you did the crime. And if you did not do the crime, then by all means do not accept punishment for something you did not do.

    But, your best bet would still be to run the whole thing by an attorney who can look into the matter on your behalf.
