    Default How to Determine if Medical Malpractice Has Occurred

    My question involves medical malpractice in the state of: Texas

    Can someone tell me where to start if I believe that there may have been medical malpractice during a recent hospital stay? I have spoken with several people at the hospital and I cannot get a straight answer from anyone, which I'm sure is standard practice. I've never dealt with anything along these lines, so I have no idea where to even begin.

    You order and pay for your medical records from the doctor, and then take them to a malpractice attorney for review, he will let you know if you have a case or not.

    Ok, so I definitely need to start with the attorney? They will know what's standard practice at a hospital and what isnt? I'm not being facetious, I'm really wanting to know.

    Yes, that's pretty much your first step.

    Please remember though that a bad result does not necessarily mean malpractice. I'm not commenting on your situation in particular but the vast majority of people who think they have a case actually don't.
