    Question Ending Probation Early

    I got in to some trouble in january of 2006 for Felony Evading an Officer and a Wet and wreckless. It was my first offense and I was 19. I was sentenced to 120 days county and 6 weeks of the DUI classes, 3 years formal probation... Plus obviously restitition and fines.. even tho it has only been about 7 months if I have everything paid off, completed and have had no problems.. is it likely if i petition the court that they would allow me to get off probation early to move out of the county and go to school and to get a decent job.

    *(part of my plea bargin was that the DA would not contest the court changing my Felony to a misdomeanor upon completion of probation aswell)

    It is possible to get the term or probation shortened or perhaps have conditions removed from your probation. For example, in my jurisdiction, once fines, costs and restitution have been paid, generally the person no longer has to report to a probation officer (this is known as going to unsupervised status).

    In your case, as it appears the DA entered into a good deal with you on the front end--they may not want the term shortened or anything changed at this point in time--but it doesn't hurt to ask--it probably would be helpful to see what the DA's position on the matter is going to be for if they have no objection it is more likely the court will grant your petition/motion.

    so if i am on informal probation.... ( i think that is what you wetre talking about..) that would allow me to move to another county??? and then i dont have to check in or anything?

    Yes, that would be the effect of what I am saying. Other conditions might be left in place, however; for example, it is not uncommon to leave the condition in place that you are not to engage in any criminal activity during the remainder of your period of probation. This is done to hold it over one's head to lead a law-abiding life or risk revocation of probation and possible incarceration.
