    Default Is It Illegal for an Employer to Address His 1099 Incorrectly

    I am working on a court case to an employer, and one more thing I would like to do is add this...he sent a 1099 with an address from over 2 years ago, I went to dispute and the address was incorrect. Although incorrect I still need to sent a letter to this employer to my best knowledge. I will not except...well send it to what he sent you and its all good...

    I would like to know is it illegal for him to do this...thanks

    I think he means the employer's address was incorrect. I think he wants to dispute the 1099 numbers but can't find the employer now.
    Note that the 1099 reflects the TOTAL amount paid out to you, including the any expense amounts. You need to take the expenses off on your sched C (just in case that is your issue, it confused me many, many moons ago when I got my first 1099).

    A little more details here would get you better answers (and try sentences, it helps).

    And I read it that he sent it to an old address of the employee - but possibly because that's what kind of call I'm getting now. "Where's my W-2?" "I don't know. The Benefits office doesn't send them out. Call Payroll."

    Employers do not issue a 1099, they issue a W-2. But even if you are not provided any income document, you are required to keep records (books) showing how much income you receive and what your expenses are.
