My question involves criminal law for the state of: Pennsylvania - my 17 year-old son was arrested for shoplifting item < $20, admitted guilt to police (he won't be doing such things again), had merchandise on him, seems pretty unlikely he's going to win a "Not Guilty" verdict. We have a Right to Apply for Diversionary Program, that, assuming acceptance and successful completion, claims that there will be "no prosecution and no court trial; no fine or court costs, Criminal Complaint will be withdrawn and no local or state record of a criminal conviction". My specific questions are: will there be a record of his arrest? if so, for how long? Who or whom will have access to this record? Is there a retail store database which will maintain his name on a list (the store was CVS). In essence, I seek to understand what he must disclose, and who/whom will have access to any of this information in future job applications, security clearances, whatever... The Diversionary Program sounds wonderful, I just need to know if and what stigma is attached. Thanks.
