My question involves a speeding ticket from the State of: Washington.
On 1/27/11 I received a speeding ticket (75 in a 60 zone) in Pierce County on I-5 near exit 127. I responded to the NOI yesterday (2/1/11) in person at Pierce County District Court #1 and received a date of March 22nd for my Contested Hearing. Persuant to LARLJ 7B, I also submitted a Discovery Request for the following:
1. A copy of the infraction.
2. A copy of the officer's report.
3. A copy of the SMD certification.
As soon as I get the discovery items back I will post them for review. However my initial question is regarding LIRLJ 2.2. When I responded to the NOI the clerk informed me that there was no record yet (obviously the officer has until Friday to file it) but when she took my copy she stamped it "Filed from the Green" with the date. Does this mean my ticket has now been filed as it pertains to this law? I'm assuming it does not however the law does not appear to specify who has to file, just that "When the Notice of Infraction is presented to the Court, the Court clerk shall stamp the citation with the current date and the infraction shall be deemed filed on that date..."
Anyway maybe I am just reading too much into this. Any and all help would be much appreciated and as I said, I will post the documents from discovery as soon as I receive them from the court. Thank you.
