    Default Tax Refund Garnishment Over Student Loans - Should Married Couples File Separately

    My question involves collection proceedings in the State of: Went to college in PA, and now living in IN.

    Long story short: I moved several times after college, and did not understand the importance of changing my address with my debtors. I thought I was paying on all of my loans, but found out from the court summons that I was only paying the federal government through AES, not TERI. They would NOT let me set up a payment plan--I had no choice but to go to court. Now, I am being garnished for only the TERI loan (25%, which is killing me, but I understand). Everything else is taken care of.

    I married within the last year, and now I am worried that they will take our tax refund.

    My question is, will filing our taxes separately prevent TERI from taking part of our refund, or will they take it regardless?

    If you file separately, they should not take your spouse's tax refund. (But you will want to be careful that filing separately doesn't raise your tax liability.)
