My question involves labor and employment law for the state of: Michigan
I have been at my current place of employment for over 3 1/2 years. When I began in the entry level position I was pregnant. I informed my manager after my training, and there was no issue with it. I worked up until the day before I had my first son, took off three weeks of maternity leave and returned to work (my job is administrative and requires very little physical strain, so I was able to return quickly). A year later I found out I was pregnant for a second time. Again, there were no issues, I did leave one week before having my second son, and took off one month before returning to work. During both pregnancies I continued to work at the same pace as my co-workers and never complained about working odd shifts. My employer is open 24/7, so occasionally employees are scheduled with only one shift, an 8 hour period, between shifts.
After the birth of my second son, and having taken on several more responsibilities then my coworkers, I was promoted to supervisor and given a raise. I am currently 6 1/2 months pregnant for a third time. I have been able to maintain my responsibilites and my job performance has never been questioned. I did express to my manager a desire to give up one responsibility, writing the schedule, due to the frustration I was feeling from not being able to schedule the people I wanted in the time I wanted based on their ability to perform their job. I felt my authority was being underminded in order to keep people happy who were not as capable at doing their job as others.
Within the last week I sat down with my manager to again express my frustration with the schedule writing. I was told that in order to help everyone feel less stress, responsibilities were being distributed more evenly amongst the employees and I was being stripped of my title as supervisor. My manager flat out told me it was so I would feel less stress and allow me to spend more time with my family. I have never indicated a desire to be relieved of my position and believe that the demotion (they did not change my pay) is due to the fact that I am pregnant, since that is what I was told. I know it is also partialy to do with the fact that I am going back to school and studying in a field NOT related to my job position.
I am not interested in filing a lawsuit, but I want to make my employer aware of any law or statute they are breaking by making this move. At this point the supervisor position has not been refilled. He made it seem as though it would not be, but I believe they are biding their time until I am off on my maternity leave to promote a new employee.
What should I do, and what are my rights here, if any?
