    Default Security Deposit in a Sublease

    My question involves landlord-tenant law in the State of: New York

    I will be entering into a sublease for an apartment. The issue is that the tenant who is leasing it will be leaving the country. I think it's risky to pay a security deposit directly to the tenant since it's going to be difficult for me to get it back if any issues should arise. What is the best way to handle this? I've thought about getting the landlord to hold my security deposit as well. But are there any other viable alternatives?

    You can try negotiating with the tenant such that you wouldn't pay a security deposit. I have no way of knowing if they'll go for that idea.
