    Angry Boundary Line Problems with Nasty Neighbors

    Help!!!
    I have the neighbors from hell. We have lived here in Chester NH for over 6 years. A small farming comunity. With in the last 4 years development has increased and a new develpoment was put in behind our lot. It is a Home owners association. They own their house but don't own their land. So when they moved in 3 years ago we had a kennel of beagles, 3 pigs, chickens and other farm animals. The neighbors started to complain about the dogs barking and the other animals. Last year we got rid of everything. I now only have 2 koi ponds. 3 weeks ago I received a nasty letter stating that we were on their land and that we needed to move some of our stuff off of their land. The week after that we found them in our back yard staking our lot. They supposedly had the land surveyed, however the surveyor did not complete the lot. They only had it surveyed where it applied to them, and thought that they would add additional stakes, colored them bright pink. We called the police, and the police made them stop because they were not licensed surveyors. So yesterday they were putting up a fence. We called the police again, and they said that we needed proof that our survey is different from their survey. Now here is the kicker...In november of 2005 my husband and I sold this house to my mother-in-law short term due to some financial issues. We do not have a lot of money and these people know it. I feel it is one of those if you have the money then they win. All because these city people moved into a farming comunity and don't like our farm house. We have a surveyor coming out this week. We gave the man our deed, and he said he would be right out. I need to know if it is illegal to remove the wooden stakes? The police were out to my house today because the neighbors said we pulled them out. I stated to the police I had know knowledge of this He stated that it was illegal, I said well I guess they are going to have to prove that I pulled them out!!! So I need to know where I can go and get information (free) on our states laws on boundaries and survey laws. and also about common land, which is where they are putting up the fence. Please help me...All I want to do is raise my children and mind my own business, and not be harrassed by these people!!

    If the police have told you not to remove the stakes, it is wise to at least consult a local lawyer before pulling out the stakes, so that you can understand and accept the full consequences.

    You may find these statutes to be informative.

    It was in the hands of the solicitors but our solicitors were closed by the law society so all the Legal paperwork got sent back to us. We haven't moved any stakes, he was caught in the garden when the previous people lived here moving them!! Of course that caused anyother despute to which we have only just become aware off by reading the documents sent to us. The fence has been there over 15yrs. The neighbour even stopped the builing work and got the builders to move the position of the house. The reason we are now without a solicitor is because our original solicitor who delt with the purchase is no longer working there but working with the previous owners solicitor so therefore we have to take them to court for miss conduct.(or so they advised) but we can't seem to find anyone to help with this matter or to pursue another solicitor!. If the summerhouse that we are errecting is within this so called stake, then can we continue, are we within our rights to put up the summerhouse. Many thanks.

    oops sorry for the above i think its got posted to the wrong place my fault.

    But to the question in hand we have been trying to take our neighbours to court and its cost a fortune unless you have legal cover on your mortgage which we had but they still won't cover us. It seems to me people can do what they like and its the innocent who have to pay and get the headache!
