My question involves collection proceedings in the State of Texas. I am hoping for help and can't seem to find the answers I need from researching. Any help will be greatly appreciated. This morning, I received an alert from my Equifax Credit Watch for my husband. The alert said that a Suit or Judgement was added to the Experian Credit Report (I do not pay for the service to have any other credit reports -- other than Equifax -- update.) The alert said that it was for Suit or Judgement, under Court/Case Number it listed First Premier Bank of Sioux Falls, ND; gave the amount $423; and that was it. We have not been served any paper work; we did move about 13 months ago; but the information on our credit report is current and up to date if a creditor needed to find us. AND the bad thing is that I can't remember if this is a valid debt or not. I, before married, had a credit card through this bank and my now husband was listed as a second card holder. That card was turned over to collections, however in August 2002 I paid the amount via electronic debt. I do not know if this card is the same account or a new one my husband might have aquired that I was unaware. I guess my question is....do we have to be served in Texas for a suit/judgement? what court will it be filed in? will it be in my county/state? or that of the banks? and can they put that on your credit report without us being served/going to court.
