    Default Are You Required to File a 1098-T with Your Return

    Hello,

    Filling Married Jointly

    I have a 1098-T for Grad school and my tuition (which is $50,000) so I know that I am already claiming the maxium education credit. My wife took an online course and we just paid for the tuition outright (it was only $311). Id like to file our taxes now and I know her 1098T will have no effect on our educational credits. We are waiting for hers to be sent, but we would like to file now. I know this is a lot of information for a simple question, but I was just wondering if it is required to file a 1098-T. I can't seem to find any reference online, not even on the IRS website.

    You are incorrect. The maximum tax credit is per student, not per return. Theoretically you could have as many maximum education credits as you had students, as long as you have tax to credit against. However, since your wife would have to do the Lifetime Learning credit you are correct that it wouldn't make a huge difference on your return, since the credit is 20% of tuition and fees paid.

    No one is ever REQUIRED to take a tax credit.

    That is what I thought. I mean entering the info into Turbotax, it didn't change the amount at all. I just wanted to make sure my return would not be rejected for not filling. Thanks
