    Default Suing in Small Claims Court if I've Moved to A Different State

    My question involves a security deposit in the State of: New York.

    I moved out on September 1st.

    My lease expired in October 30th.

    On November 16th I called to ask after my security deposit and was told that it had been mailed out the week previous.

    When I didn't receive it I called again in December and was told that it was a mail mix up and that they would fix it.

    I gave it another month (since the landlord technically has 60 days) and now we're pushing on 90 days.

    I have all the paperwork from the final walk through showing that I vacated in September and I have copies of my checks showing that I paid my rent for every month of the lease.

    My question is this: If I now live 600 miles away, how do I settle the matter? Can I still file something through small claims?

    At this point it's not so much a matter of the $1000 deposit as it is of my being pissed at the continuous run around I'm being given. If I have to pay a lawyer $1000 so that he doesn't get to keep the money I'd happily do it.

    Can I still file something through small claims?
    Yes. You would need to file in the city in which the defendant resides, unless the suit is to be files in NYC, in which case you would need to consult an attorney.
