My question involves an eviction in the state of: Texas
I bought a house (with a current mortgage) in 2005. I allowed my friend to move in with me when he lost his job 15 months ago in Nov. 09. He has never paid rent and there was no rent agreement. Nor was there any length of stay agreement. No money has exchanged hands for payment towards the home. He does owe me over $6,000 (after paying me $3,400 before he lost his job) and has only made 1 payment toward the loan.
He owns his own home (in fact 2) but they do not have utilities so he can save money. He has continued to receive his mail at his primary residence. His license still reflects his primary residence.
The environment is now unhealthy and we argue and do not get along. I told him to leave 5 days ago, and he refused. What are my rights? What are his rights? I want to do this the correct way because I do not want to get stuck with a law suit. He seems very vindictive at this point.
