    Default Charged with 2nd degree retail fraud

    I was arrested for retail fraud in the 2nd degree. I was supposed to post a bond of 250.00 to get out of jail, but since I'm ill and they didn't want to deal with all of my medications, they let me go. My arraignment is on June 8 in Troy, the woman on the phone told me to bring 500.00 - 1000.00 for bail. I don't have that kind of money or any money at all. If they let me go without bail and I show up to the arraignment, will they still set a bail?

    Also, what are my chances of getting jail time for this? It's my first offense, I've been living under extreme stress, have Post Traumatic Stress Disorder, and my therapist and psychiatrist said to plead not guilty, due to the PTSD and the stress I have been living under. I was taped in the security office and signed paper's that I did do this thing. Are the chances good that I will get a plea, and not serve any jail time? It seems like everything I have read on retail fraud in MI, everyone has been sentenced to jail time. Do you believe this to be the case?

    It isn't clear whether a bail was set, and they let you go anyway, or if they intend to set bail at that hearing. It sounds like they intend to set bail then, so you would have the opportunity to argue for a continued PR bond (what you have now - a "personal recognizance bond" which doesn't require you to pay money).

    Is this your first offense? If so, you have a substantial chance of getting probation, perhaps with an associated sentence of community service, work program, or something similar. Of course, it depends on the county - the more urban the county, the lower the chances of incarceration for a first offense shoplifting charge.

    They had set a bail of 250.00, but ended up letting me go w/o paying anything because I was ill. I think if I show up for the arraignment it show's good faith, and that I'm not running from anything. I was shocked that the woman from the court told me to bring 500.00 - 1000.00 with me for bail.

    This is my first offense, and it's in Oakland county. Still wondering if my chances for probation are good or not. What do you think?

    Your chances depend upon (a) your record, and (b) whether or not you were on probation at the time of the offense. I suggest you consult a lawyer, or petition for appointed counsel.

    Hi aaron, I appreciate all of your help. I was just let off probation the day before this offense. It was for assualt and battery, and was let off 4 months early. The cops thought it was really cute that the day after I was let off probation, I commited a crime. But there are extenuating circumstances to say the least, and I've never been in this kind of trouble before. I will plead not guilty at the arraignment, and then ask for a publice defender.
