    Thumbs up Spouse Left Job of 17 Years for Potential Better Hours

    My question involves labor and employment law for the state of: Kentucky : ( we reside in Ohio)
    First, let me say thank you in advance for reading this thread . Now, on to business .
    My wife was working at a job for seventeen years and decided to try and find one with better hours as she wants to spend more time with the children before it's too late . Now, she submits resumes and gets a interview with the gentleman that runs the place. He asks why she wants to leave her current job and she replies because of the hours and wanted something more "family friendly" . He preceded to tell her that if she took the job at his pharmacy she would work only two shifts :
    (1st.) 9-5:30
    (2nd.) 10-6
    That said , after the long interviewing process they offered her the position and she replied that she would think about it . Well, after a day or so of weighing pros and cons and tells him that she would love the new position and could start after she put in her two week notice at her old pharmacy . At this point , he reassured her again of only the two shifts .
    Well, it's been almost three months now and she has been working everyday for almost elven hours a day . She can't stand it no more , it has cause a lot of stress on the family trying to manage the kids , getting them to their stuff etc....
    All she wants is to work her hours that she was told she was going to be working , nothing more , nothing less and they refuse . Does she have any recourse at all ? She hates the idea of having thrown away almost 18 years and lots of vacation time etc.. because of this . Anything ? She just wants to be home ? I know to some , this question may be a bit silly and I apologize if you see it as so, however, it is really taking it's toll on the family .

    Sorry, but unless she has a legally binding and enforceable contract that she will work those hours, only those hours, and never have to put in any overtime, she works the hours her employer wants/needs her to work. What an employer *thinks* is going to happen at the time of hire does not always happen, and a prediction made at hire is rarely legally binding.

    They don't even pay her overtime . Just a flat hourly rate . Thanks for your reply , it's very much appreciated .
