My question involves criminal law for the state of: Iowa
My boyfriend and I left the bar that his band was playing at and got pulled over for going down the wrong way on a one way (had never been to that city before). He was driving and they pulled him out to do field tests regarding OWI. The other cop stood by my door. I had my window rolled down and beyond my best judgment, kept telling my boyfriend not to blow. I asked the officer that stayed with me to get my boyfriend's phone to call someone, as I had left my purse (with my phone) at the place we were just at. He told me, "to wait and see what happens, and we can get it later". When they arrested my boyfriend, I popped open the door telling him that I needed that phone. I was arrested for public intox and interfering with official acts. I didn't take any of the tests offered.
I pled not guilty at the hearing, but my question is if any of these charges can be dismissed or what I need to do to fight this. I wasn't "in public", I was in the truck. I didn't take any tests, but they do have it recorded that I admitted to having alcohol. Also, there were two police cars. One was across the parking lot, with my boyfriend. The other was with the truck I was in, but I can tell you that I couldn't see the car out of my peripheral vision. I say this because if the camera couldn't record me, then would there be proof of what went on?
I realize that things that I did were definitely done in poor judgment. What's done is done and I need to see if I can keep this damage to a minimum. I am a nursing student and already have a DUI from my more reckless days.
