    i have completed the program with tops honors and a 4.0gpa. yes i do believe that my background disqualifies me from working as a medical assistant based on what i have been told numerous times. i believe that if i shouldnt have been allowed in the program to begin with because my background wont allow me to work in the field then yes i shouldnt have to repay the loans. its not my fault that they allowed me in the program with full knowledge of my background.

    I hate to say this, but it actually IS your problem, not theirs, if you don't meet other requirements after you've completed the program. They aren't going to run criminal background checks on every applicant and I seriously doubt they will be held liable.

    Regardless, you need to check with the State licensing board in Ohio to see if your criminal history DOES disqualify you automatically.

    Frankly I think you have an uphill battle on your hands - your attorney is apparently asking you for something that doesn't exist, and you're probably going to find that the school has all kinds of disclaimers.

    What's perhaps more important though is that to discharge loans in bankruptcy, they must meet the Brunner standard - and that has nothing whatsoever to do with your situation. It's purely about hardship, not about whether you think it was unfair of the school to accept you or not.

    you would think that they should run background checks on people applying for school in the medical field....so issues like this dont arise

    It's the student's responsibility to research before they waste time and money. Y'know?

    The problem you run into here is that some people take classes because they enjoy them or the topic interests them, not necessarily to seek employment. So they can't say...oh you're a criminal so you can't take this class cause you can't get a job in this field. If a convicted person wants to take a class for personal enrichment, so long as there is no bar on it in their probation/parole, it's a free country.

    As Dogmatique has told you....you're facing an uphill battle that you may/probably will not win.
