My question involves emancipation laws for the State of: North Carolina.

Hello. I am 16 years old. I am currently attending a boarding school in NC for the academically gifted. This school is tuition-free (this includes all meals), and although I am not currently employed, I have previously held two jobs (waitress, legal secretary), and I have enough money saved to get me through the end of the school year. I, since June 2010, pay for all of my personal expenses except health insurance and cell phone.
My problem is this: my mother will not let me get my license, I am not allowed to make my own decisions, and frankly, I do not need my parents. My mother has threatened on several occasions that she will take me out of my school after small fights that we've had. The fact is, as a parent, she can do that. I would like to be free to complete my education at the boarding school I am currently attending, and apply to go to college wherever I want to go, without needing parental permission.

I fulfill the considerations for emancipation:

(1) I make excellent grades, responsible decisions, and have shown that I am able to function as an adult;

(2) Although I am not currently employed, it is evident that I am able to support myself until the end of the school year, by which time I feel confident that I will be able to secure a job; and

(3) Although, the quality of parental support is in no way bad, I have rejected said parental supervision or support.

My question is, should I be able to secure a job that will begin in the summer, prove that this job can adequately provide for my needs and living expenses, prove that I have secured a residence (paying rent at a friend's house), and show that it is in my best interests to be emancipated....... will they grant my request?

It may also be important to note that my parents are divorced. My mother is custodial, and she is the one that I am seeking to be free from.
