    Default New Jersey DWI Charge with 0.04 Breath Test

    My question involves criminal law for the state of: new jersey

    new jersey dwi charge with 0.04 breath test. its my first criminal record of any kind. i was found parked with engine on in the drivers seat taking a nap ( i seriously was not drunk or driving). i did drink at a bar but i waited til i sober up but i got tired and wanted to take a nap. i was found parked in a residential area. I do not want this on my record. i plead not guilty but i feel its my words against the cop.

    my question is what are my chances of winning and not having to pay fine or not to have this on my record? my friend said i should hire a private lawyer but it will cost in thousands which is more than the fine but if it means no record i might try... i hired a public defender but my friend said they arent very good...

    also if i am found guilty will there be a chance of jailtime? thanks

    Get a lawyer.

    The "legal limit" is only the point where they assume your intoxicated without have to show any other evidence. You can be shown to be intoxicated lower. Falling asleep at the wheel after drinking is pretty bad evidence. A lawyer can investigate the evidence and what the police testimony might be. Sobering up behind the wheel of a running vehicle defies all logic.

    It's worth to have a consultation with a lawyer or two to see what your odds are.
