Busted with Less Than a Oz and Scale but Didnt Receive a Citation - Am I in the Clear

My question involves criminal law for the state of: MA
I got busted with less than a oz of marijuana, the cop didn't arrest me or give me any sort of citation and took my number and called me the next day and said he would clear the charges if i set someone else up. I told him i didn't want to be in that situation and said no. This happened 2 nights ago and then he called me today and said he would give me one more chance to help him out, i said no again. Now he is saying im going to get a summons to court or a warrant for my arrest. Is he just trying to scare me into helping him?

Yes and no. He is trying to get you to work for him BUT he can still charge you with the possession if he so chooses regardless of whether you help him or not. In other words, the charge IS going to come back to bite you if you decline to help him out. It's fairly normal for police to offer small fish a break for a bigger fish. If the small fish doesn't play ball, it will go into the frying pan instead of the big fish.

Back in the 80's I got arrested for the remnants of what was in a straw they found in my buddies car 30 days prior. I obviously got off as so did my buddy who owned the straw as his attorney fought that there was no probable cause and won. I should use the word buddy very loosely here as the kid was a jerk IMO.

My public defender just went along with his case. How the police assumed the straw had 2 owners is still a mystery to me. But the fact is they arrested us 3o days after the findings. That bag they found of yours could be catnip for all you know right now and the bag could have just been sent to the lab overnight for inspection to confirm it was pot.

If you go along with their plan, make sure you have protection for the rest of your life or some way you can be made totally anonymous.
