    Default Cop Didn't Put Actual Speed on Ticket

    My question involves a speeding ticket from the State of: Florida

    I got pulled over apparently going 65 in a 45. Wasn't paying attention, so I can't honestly contest nor confirm the speed I was going. The cop told me that he would give me a break and not cite the speed that I was going on the ticket. He would then just give me a generic speed violation ticket which was $100+ cheaper than the 20-over ticket that I would have gotten if he hadn't been so nice.

    Does not putting the speed on the ticket open up room for me to contest the ticket successfully?

    I have 3 points on my License and with this ticket I will get an additional 3 points. Suspensions and such start at 12 points, so, not really concerned there. I am concerned about my insurance going up though.

    Do you think it's worth to contest this or just pay the fine of $165 and deal with the insurance hike?

    It depends on the language of the code section he cited you for.

    Did the officer specify the type of device and the serial number on the citation? Although there is no rule for citing the actual speed, there is a rule for citing the serial number and type of SMD on the citation. (6.445)

    The officer checked the boxes:
    • unlawful speed

    • 4-lane hwy with 20ft median outside bus. or red. dist.


    and wrote:
    • UNLAWFUL SPEED | Laser Lp02150 Within 90 Days

    • In violation of State Statute Section 316-183
