Default Fiance Denied Entry Due to Unauthorized Employment

My son's fiance from Colombia came to visit him and her friends here in the USA in 10/2010. She was questioned about her reason for being here. My son had met her Dec. 2009 and they began a relationship. She returned to Colombia 05/2010. he went to Colombia 06/2010 and asked her to marry him. She said yes. So she came to visit him in oct. They accused her of working when she was here before. They called her BFalso from Colombia but now lives in Chicago. The friend thought she was helping by saying she worked for her. So the custom's person tells fiance that her friend says she worked for her which surprised her but said she helped her friend out and in return her friend gave her money when she needed it. So they turned her away and said she can't return for 5 years. Is it possible for her to return here and marry my son? Does he need to get an attorney and if so how do you choose an attorney for this problem? They are very much in love. This isn't one of those marriages just to come to the USA. They are both Christians and spend mcuh of their time online studying the Bible. Any help?

You should have had a lawyer a long time ago. Having people lie to immigration is bad enough. At least you could have invented a story that was helpful rather than EVEN MORE ILLEGAL. If there's any chance it's going to take a GOOD lawyer, even if she waits out the five years. This is not a internet self help deal.

What? "At least you could have invented a story that was helpful rather than EVEN MORE ILLEGAL" What do you mean by that? Why would I want to invent a story? I was asking a question because I needed advice. I wasn't looking for self help. If I was I sure wouldn't come to a legal advice site. I would look for a self help forum.
You are right. She shouldn't have lied. She was afraid. They wouldn't let her talk to anyone until after she signed papers but on those papers she says I respect your laws and I do not believe I did anything wrong. She is in a country that is not friendly to Colombians with people yelling at her, searching her in away that humiliates her and she is scared. So thanks for the help.

I made a mistake when I put BF. It was her best friend that also was originally from Colombia. My son is a US citizen born and raised here. She was not working when she was here.

If she was not working, why did some one lie to immigration and say she was working. That was the "invention" I was referring to.

As I stated, this is going to take a lawyer to actually review the true facts and not the lies and other mistakes made in the telling of the story.
Even if they wait out the five year ban, that doesn't guarantee she'll be admitted.
