    Default Texas Eviction

    Hello, I have recently had my locks changed on the apt. They landlord came and took a few of my electronics from it as well. They are doing everything they need to by my lease. I know that they are doing what they must to protect them. They have not filed for eviction yet and I am hoping it doesn't come to that.

    Here is the situation... I am leaving for Army basic training in one weeks time. I have told them that I plan on paying them (i truely intend on doing that) And am offering to them to try to set up a payment plan while I am gone in basic. I will be recieving money while in basic and my father is going to handle my money. Today I am actually planning on moving my stuff to storage and will not need this apt. to stay in. Can they actually file for eviction or just non-payment.

    Any advise on what I should do seeing as how I cannot pay them at this time and very willing to set a payment schedule to ensure they recieve their money in full.

    It sounds like you have already moved out, and your landlord changed the locks. What do you mean by "just non-payment". If you are evicted for non-payment of rent, you are just as evicted as if they evict you for any other reason.

    Hey Aaron... Well I should have been more specific. What is happening is that I am still in my apartment. I plan on moving as soon as I have all the stuff out of it and cleaned it up. The problem is that I owe for this past months rent. Can they go through the process of eviction to me or since I am not living here after tonight will the more then likely just do a small claims court process to retreive their money.

    If the lease is still in effect, they may evict you. If the landlord knows you have moved out of the apartment with no intention of returning, presumably because you told him that in writing, he would probably just pursue money damages as there would not seem to be any need for an order of eviction.
