    Exclamation Getting a Passport for a Minor After Parental Abandonment

    My question involves a child custody case from the State of: Texas

    My daughter was born in 2002. I was 17. At the time, her father was in jail- his story is he was caught stealing tires off a car? I have no idea the real reason; I was young and stupid. My mother and I got him to sign papers to appoint my mother and I joint conservators, in the papers he did agree he is the father. The reason for the conservatorship with my mother was so my daughter could be on her insurance.

    My ex has only seen our daughter once in December of 2002. He has not expressed any interest in her well being or support. In fact, I don't even know where he is now.

    I married in 2006 to a military man. We are now in process of moving to Alaska. We are needing to obtain passports which have proven difficult since her father is not around and he has to sign a paper? My daughter's father is not on her birth certificate.

    Now here are my questions I am so sorry there are so many:

    1. Can we file abandonment? How do we go about that, and how long does it take?
    2. What about step parent adoption?
    3. Is there a way around this passport craziness?

    Any help or points in the right direction will be so much appreciated.

    Since the 60 minutes is up for editing I'd like to note:

    I have reviewed the court orders. My mother and I have joint managing conservatorship with the father only having rights when we agree. This is my translation of the orders.

    So, this means I would need my mother's consent and ID for a passport for my daughter, correct?

    My question about abandonment and step parent adoption still stands. Thanks ya'll!

    Seriously - you need to type, word for word, EXACTLY what the papers say. Not your translation. Because it can make a HUGE difference. Is your ex actually legally established as Dad?

    Next..why do you need passports to travel to Alaska?

    And finally - speak with a local adoption attorney. An involuntary TPR and stepparent adoption is possible, specially given that Dad hasn't been around in so long. However he'll still generally need to be at least notified, and since you don't know where he is you may need to resort to notice via publication and you want to make sure all your ducks are in order, lest Dad want to overturn it on a technicality.

    The court orders do acknowledge him as the dad. However, after reviewing it says my mother and I are joint managing conservators. It also says it is temporary. Would that be an issue? The order did indeed say that he only gets visitation and such when my mother and I agree to it.

    We need passports since we will be going by ferry to Alaska. There are possibilities that we may end up driving through a portion of Canada and we need our ducks in a row for the in cases.
