    Unhappy Charged for an Outstanding Bill Due to Error of Billing Company

    My question involves business law in the state of: Indiana
    I received a letter for my small business from the local water company. They stated that they had made an error and have not been charging me for the last 7 years for sewage usage. Due to their company rules, they cannot charge me back past 6 years. They are now charging me $2467.00 for back sewer usage for the past six years. I am to contact them to arrange payments. Since it is their error for not chargeing me all of these years and I have routinely paid the water bill each and every month....am I still liable for this whole bill? How should I approach the company? Thank you!

    Scan and post the contract from the water company that says that they can't charge you for there service after 12 months have elapsed if in there error.

    If you have it, then bring it to there attention and they will have to correct there bill. But what there probably going to do is take your monthly or quarterly payments and apply them towards the oldest bill first. So if they send you a bill for Oct, Nov and Dec of 2010 for $100.00, they will take that payment and apply it towards your oldest bill from lets say Jan, Feb and Mar of 2004.

    If you can't find wording in the contract then you are responsible for unpaid sewer bills for the last 7 years. I hope there not charging interest.

    Not exactly. That is an unusual period of time.

    More importantly, there has to be a statute of limitations. Here in FL the SOL on a contract is 5 years.
    It is unusual for any SOL to be more than that.

    There are also limits on bills, how far they can go back under consumer protection laws and the like.
    Not even the IRS can go back that far.

    I would think there is a limit of 5 years and perhaps a lot less. You'd have to do some research yourself or talk to a local lawyer.
