    Default Should I Call the Manager of the Store I Stole From

    My question involves criminal law for the state of: Illinois

    I got arrested for stealing a $6.00 shirt from old navy not too long ago, my court dates in the 25th, my paper provides the managers phone number. i was wondering if its a good idea to call the number and apologize and maybe negotiate some things and say "hey is there any way we can work this out outside of court?"

    Is this a good idea?

    NO! A VERY BAD IDEA.

    If you already have a court date, ANY communication with the store manager could be considered as tampering with a witness. The shoplifting charge will be the least of your problems.

    The manager can't settle a criminal charge out of court. Once you have criminal charges it is the state of Illinois that prosecutes you.
    You're going to court.

    I am an attorney and I know a lot about the subject of shoplifting. I am not, however, licensed in Illinois. Do not take this as creating an attorney-client relationship. Here is my opinion.

    Once the store caused criminal charges to be filed against you, it is out of their hands. Only the prosecutor can make decisions about whether to pursue the case against you. Do not try negotiating anything with the store manager or the prosecutor, on your own. You need to consult an attorney. If you cannot afford an attorney, tell the court that and ask that one be appointed for you. That is not free either. Usually there is a payback obligation, but that should be the least of your worries. An attorny can advise you as to whether there is a diversion or deferred sentencing program available which might allow you to avoid having a criminal conviction on your record. If not, your attorney can probably negotiate a better deal with the prosecutor than you can on your own.
