My question involves an auto loan or repossession in the State of: ILLINOIS
Ok so here is my story.
I Bought a vehicle in August of 2006 with a loan throgh Citi Financial Auto. October of 2008 was the last payment I have made. Since then the car has sat in my drive way and lost value. Citi filed a suit against me in December of 2009 and just repod the car on 9/11/2010. When I went to court on 12/26/10 Citi's attorney said they didnt know where the car was and needed 45days to locate the car and resell. Just two days ago I recieved the notice of resale, which was more than 90days after repo.
Is it possible for this to be commercially unreasonable being they let the cars value drop for over and year and a half?
Also it took then more than 90days to send me anykind of paper work on the resale, can i use that in defense?
If you need more information please ask. I might just get a lawyer because I feel
I got a good case.
