    Default Underpaid and Not Corrected

    My question involves employment and labor law for the state of: California

    My employer stated they switched to a new HR system. They have been messing up our checks. I was underpaid on my last check almost 2 weeks ago and brought it to their attention. They just say "we are working on it". I have a bill due and because I was shorted the money, I will only be able to make a partial payment and probably be charged interest. Is there anything I can do? Will I be able to make my employer pay the interest or am I screwed?

    So we are now going on 4 months of being under paid and 3 pay checks later still no correction. I just have to sit here and take this? What does this law pertain to then?

    "Labor Code §558 provides for a $50 penalty for an initial violation of wage and hour laws. This applies for each underpaid employee for each pay period for which the employee was underpaid in addition to the amount of underpaid wages. For each subsequent violation, a $100 penalty is owed for each pay period for which the employee was underpaid in addition to the amount of underpaid wages."

    I didn't mean there wasn't anything you can do; I meant that the employer did not have to pay you interest when they do correct it. Any penalties imposed would be paid to the state, not the employee.

    File a claim with the DLSE for unpaid wages.
