    Default Can Family Plan Be Considered As a Group Plan

    My question involves insurance law for the state of: New Jersey.

    As I know, maximum exclusion period for pre-existing condition for small groups is 6 months, for individuals - 12 (NJ). My wife is covered by insurance. with type of plan: One Parent family. Totally, three persons have been included in policy. Can it be considered as a group plan?

    No, a group does not mean it has more than one person on it. It means it has more than one family unit on it. An employer sponsored plan is a group plan. An indiviudally-offered plan that covers dependents is still an individual plan that is covering dependents.

    Actually, the very first worlds of the policy are "We certify that, as of the applicable effective date shown below, you became insured under the group insurance policy shown below." Moreover, she has a group # specified on the insurance card.

    How did your wife obtain the insurance?

    "Group" does not refer to the number of people on the policy, it refers to the pool of people holding that plan - for instance, a particular employer, or people who live in the same community who have banded together for a particular insurance rate.

    I answered the question you asked in the first post correctly given the information you provided. Had you included the rest of the information initially, the answer would have been different.

    Since it appears that you would prefer to play "gotcha" than get the legal answers to your questions, you're on your own as far as I'm concerned.
