    Default B2 Visitor Marrying a Military Citizen

    My question involves marriage law for the State of: Florida

    Hello, i am a tourist in the USA, i have a B1/B2 visa (1 year visa, multiple, expires in july 2011). My stay here expires on January 19, 2011.

    My fiancee is in air force. We want to get married next week, but by that time i might be already illegal here. I don't want to go back to my country and apply for a wife visa as normally we have to wait for this visa for at least 2 years, and we already are not going to spend that much time together because of his deployments (he leaves again in february - march for 7 - 9 months). Besides, the ticket back that i had is on 22nd of January, so i would be illegal here anyway (that was his fault )

    Will our marriage affect his career? Is it better to get married while i'm still legal here but just a tourist? Btw, i came to the USA twice before (J1 visa) and already have a social security card.
    What should i do to apply to change my status?

    He should discuss the potential impact on his career with the base legal office. I doubt that the military would smile on his conspiring to help you stay in the U.S. in violation of immigration laws.

    As you probably know, there's a risk in entering the U.S. as a tourist, getting married and trying to adjust your status, as when you enter as a tourist you represent that you have no intent to immigrate. The risk is that the USCIS may decide that was a fraudulent representation made to enter the U.S., justifying deportation and a bar against reentry.
