    Default Maryland Unemployment and the 18 Month Rule

    My question involves unemployment benefits for the state of: Maryland

    So, back in January of 2010, I voluntarily switch jobs to a more lucrative position that I was offered.

    In November of 2010, I was laid off, from that new position, and I applied for unemployment benefits while I searched for a new job.

    At this point MD Unemployment is claiming that they are going to deny me all benefits, because in the 'last 18 months' I voluntarily left a company. Even though my most recent company laid me off.

    This sounds completely ludicrous to me. I have to assume this is wrong, but on the phone I was told exactly this was the case.

    Is this true? If you voluntarily switched jobs in the last 18 months, you are denied all unemployment?

    In Maryland it can be. They have a quirk in the law that does not exist in other states re: eligibility. But there is at least one other responder here who has more experience with it than I do - I'll leave it to her to explain.

    That would be me, but in my situation the "new job" lasted only several weeks. It would seem to me that 11 months should be more than enough time to establish the new employer as a chargeable employer.

    All you can do is appeal.

    Well, that's what I've kinda done. Inadvertantly. As the story goes, The 2nd employer wasn't showing up for some reason originally on my job history.

    When I got the letter stating that I was being denied benefits because I left the 1st employer voluntarily, I assumed that it was because the 2nd employer wasn't showing up.

    I therefore filed an appeal, wherein I stated: "Yes, I did leave the first one voluntarily, but then the 2nd employer I went to, laid me off after 10 months" And I provided paystubs from the 2nd employer, showing MD tax being taken out, etc.

    The confusion then opened up, when I just received the appeal notice of my appeal appointment. And I read that according to the paperwork, that the appeal/issue was specifically: "If I'd left voluntarily or not".

    I called the appeals office to say: "Ummm, that's not my argument, my argument is that I had another job and THEY laid me off"

    And the lady on the phone told me the story, that if I left any job voluntarily in the last 18 months, that I would be disqualified.

    And my jaw dropped, and I told her I'd see her at my hearing date I guessed.

    I looked in the MD Annotated Code of Law, and honestly can't find that stated anywhere. They talk about that you need to have worked in MD within the last 18 months. But nothing about 'leaving any one job' disqualifying you.

    On a semi-related note. What happens if I get a new job before they ever pay me benefits?

    I applied at the end of November, but now 6 weeks later have yet to receive any money because of all this back-n-forth. The appeal date isn't for 3 more weeks. Making 9 weeks with no money. But I'm talking with a number of companies right now, and hope that one of them will end up working out sooner than later.

    But, then what happens? I mean, from my POV, if I started a new job in 2 weeks, they'd still owe me 8 weeks of back-insurance. But they are going to laugh in my face and shove me out the door if so? With all this effort being for naught?
