My question involves a security deposit in the State of: Texas
My landlord did not send a statement or refund my deposit until 35 days after I surrendered the property. They are keeping all of my deposit out of retaliation for a repair they had to make when I moved in. The toilet was broke before we moved in and they tried to charge me for it...until I showed them a video I took during the walk thru, showing the toielt broke before we moved in and then they backed down. They have been doing things like this thru my entire 1 year lease.
My question is: They are past the 30 days required by the Texas Property Code. I gave them 30 days notice of moving and I sent my forwarding address 9 days after I gave the notice that I was moving. They are saying they have 30 days from the date the forwarding address was given, however the TX property code says 30 days from the date the property was surrenedered "as long as" the landlord has a forwarding address. So are they still in violation of the property code or are they really allowed 30 days from the date the forwarding address was given?
