My question involves criminal law for the state of: New Mexico.

Two days ago, my boyfriend and I went out with some friends to celebrate. We both got pretty intoxicated (he more than I) and decided to go back to his house. We began an argument over something petty and I told him I wanted to go home. He was afraid that I was going to drive so he took my purse. While trying to get it back from him, he let go of it and it hit me in the face. Angry, I ran over to his neighbor's house to call the police.

The police came to his residence and asked me what happened. I explained the situation, that he had "hit me in the face with my purse" and that all I wanted to do was get my stuff and go home. I never had any intention of him being arrested because he really didn't do anything.

The officer looked at my face for any marks (there were none) and proceeded to arrest my boyfriend. After 8 hours in jail, they released him with no bond. He was charged with battery, larceny (since he had my purse in his house) and obstruction of communication (my cell phone was in my purse). This is absolutely the most ridiculous thing! He was trying to make sure that I didn't drive home and I overreacted by calling the police. He never hurt me..the purse was a complete accident.

I am planning on getting the police report and we are hiring an attorney on Monday. I realize that it is up to the prosecutor to drop the case but I was just wondering if anyone has any advice on how to deal with this situation. Thank you.
