Default Re: Stopping a name change

The mother can petition for a name change without the father's consent. He can go to court in response to the petition and advocate against the name change. Typically where there is a prior custody order a court will apply a "best interest" standard in relation to a requested name change - that is, the court won't change a child's name over the objection of a parent unless the court determines the name change to be in the child's best interest.
