    Default Land Dispute Turned Extortion

    My question involves criminal law for the state of: Georgia

    My inlaws come from Vietnam. They entered the country legally and in the process of obtaining citizenship, thought they could not own a business.

    As immigrants seeking citizenship they worked till able to buy a farm, with the help of an aunt to cosign the papers. This aunt would cosign with them on all documents so that they could buy the farm. Her name was on documents as the primary owner. None of the aunt's money was used to buy this farm, just her name.

    After becoming US citizens the family wants the aunt to release her name from all the deeds so that they can own the farm solely in their own names. The aunt insisted that she was due money for helping them all this time. Afterwards, the aunt gets married and now wants to buy a farm of her own. She can not buy another farm in her name while her name is on the current farm, because the mortgage on the current farm is not paid. The aunt signs all necessary paperwork to sign the farm over to the family.

    Later the aunt takes the father out into the farm and forces him to sign a document that says he must give her 100,000$ for the "pain and suffering caused by verbal attacks". He gives her a check for that amount, to be deposited later, because of insufficient funds. They still do not have that amount in their account, so if she cashed the check it must have bounced or she has not cashed the check yet.

    The aunt has just served the family with some kind of lawsuit. I have no current details about the lawsuit, the family is unable to read the papers, because of the legal jargon, till their son can reach them to translate.

    Is this a case of extortion of some kind? What legal grounds do the family have to fight this lawsuit? Where should they go for help with this, what kind of lawyer, how can i search for one?

    Before actually signing over the farm, the aunt tried for years to get money from the family to release her name from the ownership. Asking/demanding anywhere from 300,000$ to threatening to take the whole farm away. Only after realizing that she can not obtain a farm of her own with her name on the mortgages did she consider signing the farm over to the family. The lawsuit most likely demands some amount of money or the ownership of the whole farm itself.

    Why don't you find out all the details then come back and post what the lawsuit is over, what monies/land are wanted and what the document that was signed says.
