In Florida you may find that your judge is reluctant to waive mediation; depends on the judge. And you may just end up delaying the case after the judge admonishes your husband for not turning in paperwork and then continues it to allow him to get it filed. If you don't have an attorney, I encourage you to interview some and see if you can hire one to help you turn your husband's refusal to file the required documents to your advantage. Also, you would be better off in mediation with an attorney handling it for you, rather than alone, especially with the former abusive relationship. And yes, there is a chance he could get equal time sharing of the child since the law presumes equal time to be best for the child's interests. Again, you may find that an experienced attorney would be more effective at bringing out the reasons why the child would not benefit from equal time arrangements in the parenting plan. Good luck!
