    Default Speedy Trial Rights in Traffic Court

    My question involves traffic court in the State of: California I received a red light camera ticket in the mail. It's not me driving. I am not goning to rat out who it was. Plead not guilty today. The soonest court date they gave me was in August 2011. Wow I thought we had a right to a speedy trial within 45 days. I was told there is only one judge at this court that hears traffic cases. What do you think.

    Did you enter your plea of "not guilty" in front of a judge/commissioner or did you just appear at the clerk's window and request a court appearance?

    What was the scheduled appearance date on the "notice to appear"?

    At the clerk I was told I could not see the judge.

    Then your August/2011 appearance will be your arraignment and upon a "not guilty" plea, the court will have to schedule your trial date within 45 days of that date (unless you waive time).
