    Default Former Employer Refuses to Hand Over Paperwork

    My question involves labor and employment law for the state of: CA

    The short version of this story is:


    My friend's father was recently fired from his job at a family run grocery store (not his family). The father had been told his hours were going to be cut to 6 hours per week.. an argument ensued and he was fired. While he was in this very emotional state they had him sign this mystery document.. and are now refusing to provide a copy of it. He asked for a copy at the time he left and was told that HR would mail it him. It's now been over two weeks and he has rec'd nothing; when he calls they play the run around game on the phone....

    without actually knowing what the document states (but likely something that says he quit voluntarily...) what are his legal options for obtaining a copy of it and disputing it.

    If I can skip any snarky remarks about him signing a document without knowing what it was... that'd be great. Thanks for any advice.

    Well, two weeks? During the Christmas/New Year period? Really?

    If he has not already done so, your friend's father should go ahead & file for unemployment
    insurance. (Get the claim started.) The state will make the decision whether he receives it or not. A person should always file & if denied, appeal.

    My recollection is that California law requires that the employer provide a copy of any document the employee has signed.

    Having said that, I wonder about someone who would sign ANYTHING without having read it; there is NO WAY this should be a "mystery document".

    @Dogmatique... normally, I'd say you're right about the wait time/time of year issue... but really.. they're beating around the bush hoping he'll be a pushover and forget the whole thing.

    @Betty3 Thank you very VERY much for the link and he has started the EDD claim process and had his interview but.. of course.. the former employer is disputing it. He did let EDD know he felt coerced into signing whatever it was that he signed...

    which brings me to ..

    @PattyPA... I have to say, I was also, I don't know, astounded(?) that in this day and age that someone would sign something without reading it... but.... whatever, the damage is done. He's sticking to his story and I'm just trying to help a friend out. Any other ideas are welcome (sans the snark, of course) Thank you all again.
