    Default Non-Custodial Parent Looking for Advice on Step Parent Adoption

    My question involves adoption law for the State of: Idaho

    Here's the breakdown --

    Have a two 1/2 yr old daughter in Idaho born out of wedlock (were never married) we stayed topgether until she was just over 13 months old. Due to relationship issues we decided it was in everyone's best interests that I left the home. Having nowhere to go in Idaho I moved back to Seattle causing visitation to be a problem. With no relaiable transportation my daughter doesn't know who I am. My ex had her new BF move in about a week after me leaving so my daughter has of course called him Daddy since she started talking after I left. Being she is so young and has someone there fulltime the Ex has always wanted me to sign over my rights since day one. I finally see her point in the matter and see I'm hurting my daughter more by holding onto her. So we've determined it is in her best interest that the BF adopts her. Now my question is can I relinquish my rights without there being a petition for a adoption filed yet? My ex is telling me I can but everything I find is telling me the oppsite. Does anyone know if I can relinquish my rights before the petition for the adoption?

    Her boyfriend cannot adopt her unless he marries Mom.

    Your rights - once this happens and they're stable - will be terminated as part of the adoption proceedings.
